Terms of use

These are the rules for using OPEN. The most important one is section 3 - accuracy. Please read that one even if you skip the rest.
1.This agreement
The service is operated by Shimon Yehuda Cohen, a registered sole proprietor (dealer number 317735439), of 12/3 HaRav Eliyahu Lopian St., Jerusalem “We” in this document means the operator; “you” means anyone using OPEN.
Using the app, the openow.app website or the MCP server means you accept these terms. If you do not accept them, do not use the service.
2.What OPEN does
OPEN shows which businesses are open right now and until when. The information comes from two sources: updates by business owners, and confirmations and reports by users. We do not produce the information and we do not check every update one by one.
OPEN is an information layer. It does not order, sell or reserve anything, and it is not a party to any transaction you make with a business.
3.Accuracy - the section to read
OPEN reports live availability contributed by business owners and other users. It can therefore be wrong, or out of date. A business can lock its door a minute after saying it is open, and a user can confirm a status by mistake.
Do not rely on OPEN where being wrong is costly. Two explicit examples: before an unusually long journey, and before going to a pharmacy for a medical need - call the business and check.
This section is emphasised deliberately, not as routine boilerplate: the entire product is a claim about the physical world at this instant, so the possible gap between the claim and reality is the central risk in using it.
4.UNKNOWN is not CLOSED
When OPEN has no current information about a business, it shows “unknown”. It does not show “closed”. That is a deliberate product decision: an absence of information is not evidence of closure, and wrongly marking a business closed does it real harm.
“Unknown” is not a statement by us about the business; it is an admission that we do not know. Equally, “open” is not a promise - it is the most recent report received, with its timestamp and its source. Always look at both of those.
5.Your account
- Give accurate details, and keep your password to yourself.
- You are responsible for what is done from your account.
- One account per person. Do not impersonate another person or another business.
What is stored in an account, and what is done with it, is described in the privacy policy.
6.Content you contribute
A status confirmation, a report, or free text you add is a contribution to the service. The rules:
- Report only what you saw or know. A false confirmation harms the business and other users.
- Do not use reports to damage a competitor or to take revenge on a business.
- No abusive, threatening or hateful content, and nothing that infringes anyone’s rights.
- No spam, no automation, no flooding reports.
You permit us to display your contribution in the service and to use it to compute status. We may remove a contribution, and in repeated cases suspend or block an account.
Found wrong information, an abusive contribution, or a business that has opened or closed? Use the report button on the business page in the app, or write to hello@openow.app. We handle reports in order of importance, and a report about information that could cause harm is handled first.
7.Business owners who claim a listing
A claim is a request, and a person on our team reviews it. When you claim a business you represent and undertake that:
- The business is yours, or you are authorised to act for it. Do not claim a business that is not yours.
- You will keep the status accurate. If you closed, update it. If the status expired, renew it or let it expire.
- You will not publish “open” to attract customers while you are closed. That is a serious breach, and on its own enough to revoke the claim and block the account.
- The business information you enter - name, address, phone, hours - is correct, and you are permitted to publish it.
An owner’s update overrides regular opening hours, which makes it the highest-responsibility action in the service. We may revoke a claim or correct a status if we receive reasonable evidence that it is wrong.
8.Cost
We are in a pilot period, and signing up for OPEN and using it are free.
There is no billing in OPEN at all: no payment, no payment method required, and no subscription. Nor is there a paid plan on offer to you right now.
If we offer a paid service in the future, we will say so in advance. Before any payment, the price in effect, what it includes, the billing cycle and how to cancel will all be shown, and your explicit agreement will be required. Nothing you use today obliges you to pay anything later.
9.Prohibited uses
- Systematically scraping or downloading the database, or building a competing service from it.
- Circumventing rate limits, authentication or permissions.
- Reverse engineering the service, beyond what the law expressly permits.
- Overloading or interfering with the service, or harming other users.
- Using the service for any unlawful purpose.
10.OPEN inside chat assistants
Connecting OPEN to Claude or ChatGPT is intended for ordinary personal use, and it is read-only. These terms apply to it as well.
The conversation itself takes place at the assistant’s provider and is governed by that provider’s terms. An answer the assistant writes can be wrong or incomplete, and section 3 applies to it in full.
The map is displayed using data and tiles from OpenStreetMap and its contributors, in accordance with their terms of use.
11.Intellectual property
The OPEN name, the website, the app, the design and the code are ours. Do not copy them or create derivative works from them without written permission.
Your contributions remain yours. You grant us a non-exclusive, royalty-free licence to display them in the service and to use them to operate it.
12.Service availability
OPEN is under development. We may change, add or remove features, and may suspend or discontinue the service. We do not promise uninterrupted availability.
13.Disclaimers and limitation of liability
The service is provided as is and as available. We do not warrant that a displayed status is correct, complete or current, and we do not warrant any particular outcome from using it.
To the extent permitted by law, we are not liable for indirect or consequential damage, or for lost time, expenses or opportunity arising from reliance on information in the service - for example, travelling to a business that turned out to be closed. Our total liability, if established, will not exceed 100 Israeli new shekels or the amount you paid us in the six months preceding the event, whichever is higher.
This section does not derogate from rights that cannot be waived under Israeli law, and does not limit liability for damage caused maliciously.
14.Termination
You may stop using OPEN at any time. For account deletion, see the privacy policy.
We may suspend or close an account that breaches these terms, and in particular an account that knowingly publishes a false status or claims a business that is not its own.
15.Changes to these terms
If we change these terms we will update the effective date at the top of the page. A material change will be brought to your attention before it takes effect, and continued use afterwards means you accept the updated terms.
16.Governing law and jurisdiction
These terms are governed by Israeli law alone. The competent courts in Israel have exclusive jurisdiction over any matter relating to them.
